Buying a House in Spain from the UK

Buying or selling a house abroad, whether it is a holiday home or for permanent residency, can be a difficult process - especially if you are having to approach the task from overseas.

Spanish property is no different and it is highly advisable to seek specialist advice from dedicated Spanish property solicitors.

What Do You Need to Consider When Buying a Property in Spain?

The language barrier if you’re not a fluent Spanish speaker can be difficult when buying assets in Spain. As well as this, the legal system is very different from the UK.

If you fall behind with mortgage payments in Spain, the Spanish bank may not only repossess your Spanish property, but they may also lay a claim against your assets in the UK.

Interest rates and cancellation fees are another aspect to consider as these are communicated and calculated differently in Spain.

Residency must be applied for if you reside in Spain for more than three months. After Brexit, there are a series of visas and resident permits that can be applied for.

How Labrums Can Help You When Buying a Spanish Property

Our in-house Spanish solicitor Sergio Zamudio specialises in advising Britons buying property overseas, particularly where property development is concerned.

Sergio can assist you in the purchase of your property, by giving you independent advice and dealing directly with the vendors and their agents (or the buyer). Sergio will review the contract and its conditions, complete Land Registry searches and where applicable, obtain building certificates and/ planning status from the council. He will also establish whether the previous owners have any unpaid utility or tax bills in relation to the property and that the utilities are in fact still connected.

If you are buying a “new build”, Sergio will supervise the relevant documents from the builder, deal with bank guarantees and appoint a notary for you for completion.

After completion, Labrums will then ensure the tax is paid, the property is registered in your name at the Land Registry and that the utilities are transferred to your name.

We will forward the deeds and receipts of any payments made on your behalf (Notary, Registry’s fees, taxes, etc.) to you so you have all the relevant documentation.

We can also help you by obtaining NIE numbers and arranging any money transfers that will be required for your purchase. Within our Spanish Department there is great expertise to help you avoid the pitfalls and to ensure your purchase goes smoothly.

Currency and the Exchange Rate

Buying a property overseas is not an everyday expense and you should not use an everyday finance provider.

If you fall behind with mortgage payments in Spain, the Spanish bank may not only repossess your Spanish property, but they may also lay a claim against your assets in the UK.

Since 2004, Smart has helped thousands of people successfully buy abroad. Smart has the same ethos as Labrums in its determination to exceed client expectations and achieve the outcomes they want.

Smart's rates are as competitive as any other currency provider, but they have been voted as one of the most trusted British companies for “currency exchange” and “money transfers” with thousands of ratings on the website Trustpilot.

You can open a free account with them and are able to chat about the best approach to take when buying abroad, with a real currency expert, not a call centre.

I would use your services again (and) I would have no hesitation in recommending you to others.
