Most people thought they had no chance of seeing their money again, but a ruling by the Spanish Supreme Court in December 2015 changed that.

Banks in Spain are now liable to refund money which was paid and lost by home buyers

where the developer or builder failed to complete the properties. The refund can be claimed regardless of whether or not a bank guarantee was in place and regardless of the solvency status of the developer.

You can make a claim if:

  • You are an EU, or British, citizen
  • You paid a deposit for an off-plan Spanish Property
  • You never took ownership of the property, the property was never completed, or building never started

Each claim must be presented individually at the Spanish courts and can only be filed once, so it is important that if you wish to make a claim you get the correct legal advice.
